Family Mediation Voucher Scheme: Are Family Mediation Vouchers Still Available?

The UK government introduced the Family Mediation Voucher Scheme, a time limited scheme designed to support parties in resolving family law disputes outside of court. This scheme offers a one off financial contribution of up to £500 towards mediation costs for eligible cases, helping separated parents and family members find solutions without the stress and expense of court proceedings.

What Is Family Mediation?

Family mediation is a process where a trained mediator helps you and your ex partner or other family members work through disagreements, particularly about child arrangements and family financial matters. Family mediators provide a safe, confidential environment to discuss issues and find solutions that work for everyone involved. Mediation services are often less stressful and quicker than going to court.

Benefits of the Family Mediation Voucher Scheme

The voucher scheme provides a significant financial contribution to reduce the overall cost of mediation sessions. Here are some key benefits:

  • Support for Low Income Families: The scheme helps families on low income access mediation services by providing voucher funding that is paid directly to the chosen mediator.

  • Encourages Disputes Outside of Court: By supporting mediation, the scheme reduces court congestion and promotes collaborative resolutions.

  • Flexibility in Resolving Disputes: Mediation allows parties to craft agreements tailored to their unique circumstances, including new arrangements as family situations change.

How Many Mediation Sessions Can the Voucher Cover?

The total value of the voucher is £500, which is intended as a contribution towards mediation sessions. The number of sessions covered depends on the rates set by your chosen mediator. Your mediator will provide information on how many mediation sessions the voucher is likely to cover and any overall cost you may need to contribute.

Eligibility Requirements and How to Apply

To be eligible for the family mediation voucher scheme, you must:

  • Attend a Mediation Information and Assessment Meeting (MIAM) with an FMC accredited mediator. This short meeting assesses whether mediation is suitable for your dispute.

  • Have a dispute relating to eligible family law matters, such as child arrangements or family financial issues.

  • Agree to attend mediation sessions with the other party.

If you meet the eligibility requirements, your mediator will apply for the voucher funding on your behalf. You will not receive a physical voucher, and there is no separate application process. Voucher funding is paid directly to the mediator once all mediation sessions are concluded.

Can You Get a Voucher If You Are Eligible for Legal Aid?

Yes, legal aid funding and the family mediation voucher scheme can work alongside each other. Legal aid may cover the cost of the MIAM and the first mediation session if you qualify. The voucher scheme provides a one off contribution towards additional mediation sessions. Your FMC accredited mediator will discuss your options, including legal aid work, during your MIAM.

What Happens If Circumstances Change?

Family mediators can assist in making new arrangements if circumstances change, such as changes in child care needs or financial situations. Mediation services often include child inclusive mediation, where the child's views can be heard safely. This flexibility helps families avoid returning to court for modifications.

Data Collection and Monitoring

As part of the scheme, you may be asked to complete a short monitoring questionnaire. Your mediator will provide some basic information about your case, such as whether you reached an agreement or requested a court order to formalise it. The data provided is anonymised and helps improve mediation services and voucher funding availability.

Important Considerations

  • The scheme is limited to one voucher per family or case. If you have already received a voucher for a dispute ongoing, you cannot claim a second voucher under the same scheme.

  • The voucher does not cover the cost of the MIAM, which you may have to pay for unless you qualify for legal aid funding.

  • Mediation is not suitable in cases involving domestic abuse or where safety concerns exist. Your mediator will assess these circumstances carefully.
